Terms and Conditions
These Terms and Conditions govern registration, participation, and attendance at events managed by GEMS Event Management Australia Pty Ltd (“GEMS”, “we”, “us”, “our”). By completing registration for any GEMS-managed event, you (“you”, “your”, “delegate”, “participant”) agree to be bound by the terms set out below. These terms supersede any other agreements to the extent of any inconsistency.
1. Definitions and Scope
These Terms and Conditions apply to all individuals and organisations registering for GEMS-managed events, including employees, contractors, sponsors, exhibitors, and any associated guests (collectively referred to as ‘participants’). References to ‘Event Organisers’ mean GEMS Event Management Australia Pty Ltd.
2. Your Capacity and Authority
You enter into this agreement in your personal capacity and, where applicable, on behalf of any organisation, employer, or guest for whom you complete the registration. You warrant that you are authorised to do so, have provided these terms to each relevant person, and have obtained their consent for GEMS to process their personal information.
3. Compliance with Venue and Event Terms
All attendees must comply with the terms and conditions of entry to each venue and follow lawful directions of venue staff and event organisers. GEMS reserves the right to remove any participant who fails to comply or whose conduct is considered inappropriate or disruptive.
4. Registration Confirmation and Payment
All online registrations submitted to GEMS are deemed confirmed by the delegate. Tentative bookings are not accepted. A confirmation email and tax invoice will be issued upon registration. Payment is required in full prior to the commencement of the event to secure attendance, unless prior arrangements are made in writing with GEMS.
5. Cancellation and Refund Policy
All cancellations must be made in writing to GEMS Event Management Australia. Cancellations received by the date specified on the event website will incur an administrative fee of AUD$125. Cancellations received after this date are non-refundable. Transfer of registration to another delegate is permitted, provided details are advised at least five (5) business days prior to the event. Non-attendance without prior notice will not be refunded.
In the case of a medical emergency which has caused a registered delegate to not attend the Conference, the Conference Organiser must be provided with a medical certificate or appropriate documentation before any refund will be considered. Where the Conference Organisers are advised of the situation after the Conference, and a refund is deemed to be appropriate, the delegate must still pay the administration fee, along with any catering charges and collateral expenses (program, satchel etc) incurred for all events at which they were scheduled to attend.
6. Event Cancellation or Postponement by GEMS
GEMS reserves the right to cancel, postpone, or change any event at its discretion. In such cases, delegates will be notified by email. If an event is cancelled, registration fees will be refunded in full. If postponed, delegates may transfer their registration to the new date or request a refund. GEMS is not responsible for any travel or accommodation costs incurred.
7. Accommodation Bookings and Cancellations
Accommodation arrangements made through GEMS or directly with accommodation providers are subject to the provider’s terms and conditions. Cancellations made within 60 days of arrival will incur a 50% fee, and those within 30 days may forfeit the full accommodation fee. No refunds apply for non-attendance.
8. Conduct and Behaviour
Participants must behave respectfully and responsibly at all times during the event. Offensive language, harassment, disruption of sessions, or endangerment of others will not be tolerated. GEMS reserves the right to remove any individual without refund should behaviour be deemed inappropriate.
9. Photography, Videography and Media
Images and recordings may be taken by GEMS or authorised service providers during the event for promotional and archival purposes. By attending, you consent to the use of your image or likeness in promotional materials. If you do not wish for your image to be used, you must advise GEMS in writing prior to the event.
10. Insurance and Risk
Registration fees do not include insurance of any kind. Delegates are strongly advised to obtain travel and personal insurance covering loss, injury, illness, property damage, or event cancellation. GEMS accepts no responsibility for any loss or damage arising from circumstances beyond its control.
11. Limitation of Liability
To the extent permitted by law, GEMS’ liability for any claim relating to attendance or participation in the event is limited to the amount of registration fees paid. GEMS shall not be liable for indirect, consequential, or incidental damages including loss of profits, enjoyment, or opportunity.
12. Indemnity
You agree to indemnify and hold harmless GEMS, its officers, employees, and contractors from and against all claims, damages, liabilities, and expenses arising from your acts, omissions, or breach of these Terms and Conditions, except where caused by the negligence of GEMS.
13. Privacy and Data Use
By registering, you consent to GEMS collecting and using your personal information in accordance with its Privacy Policy. Your name, organisation, and contact details may be shared with event partners for operational purposes. You may opt out of non-essential communications by contacting GEMS.
14. Transfer of Registration
A registration may be transferred to another delegate by written notice to GEMS, provided the replacement delegate agrees to these Terms and Conditions. No refund will be made where a transfer occurs.
15. Notices and Communication
All notices must be sent in writing to the email address supplied on the registration form. Notices from GEMS will be sent to the delegate’s nominated email address and deemed received on the date of transmission, unless outside normal business hours, in which case it is deemed received on the next business day.
16. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. By registering, you agree to submit to the non-exclusive jurisdiction of the courts of that state.
17. Force Majeure
GEMS shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, industrial disputes, or equipment failure. In such cases, GEMS may reschedule, modify, or cancel the event without liability, and any refunds will be processed at its discretion.
18. Health, Safety and Public Welfare
Participants must comply with all applicable health and safety regulations, venue requirements, and any public health directives in place at the time of the event. GEMS reserves the right to refuse entry or request removal of any delegate who fails to comply or poses a risk to others.
19. Intellectual Property
All event content, including but not limited to presentations, videos, images, and materials, remain the property of GEMS or their respective authors. Such content may not be reproduced, distributed, or used for commercial purposes without written consent from the owner.
20. Variation of Terms
GEMS reserves the right to amend or update these Terms and Conditions at any time. Updated terms will be published on the event website and are effective upon posting. Continued participation following notice constitutes acceptance of the revised terms.
21. Dispute Resolution
In the event of a dispute arising under or in connection with these Terms and Conditions, both parties agree to attempt resolution through good-faith negotiation or mediation before commencing legal proceedings.
22. Entire Agreement and Severability
These Terms and Conditions constitute the entire agreement between GEMS and the participant. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
