Terms and Conditions
These Terms and Conditions govern registration, participation, and attendance at events managed by GEMS Event Management Australia Pty Ltd (“GEMS”, “we”, “us”, “our”).
By completing registration for any GEMS-managed event, you (“you”, “your”, “delegate”, “participant”) agree to be bound by the terms set out below. These terms supersede any other agreements to the extent of any inconsistency.
These Terms and Conditions apply to all individuals and organisations registering for events managed by GEMS Event Management Australia as agents for (name of client), including employees, contractors, sponsors, exhibitors, and any associated guests (collectively referred to as ‘participants’). References to ‘Event Organisers’ mean GEMS Event Management Australia Pty Ltd and Stormwater Victoria.
You enter into this agreement in your personal capacity and, where applicable, on behalf of any organisation, employer, or guest for whom you complete the registration. You warrant that you are authorised to complete event registrations, and have provided these terms to each relevant participant, and have obtained their consent for the Event Organisers to process their personal information.
All attendees must comply with the terms and conditions of entry to each venue and follow lawful directions of venue staff and the Event Organisers reserve the right to remove any participant who fails to comply or whose conduct is considered inappropriate or disruptive.
All online registrations submitted to the Event Organisers are deemed confirmed by the participant. Tentative bookings are not accepted. A confirmation email and tax invoice will be issued upon registration. Payment is required in full prior to the commencement of the event to secure attendance, unless prior arrangements are made in writing with the Event Organisers.
Where applicable, the Event Organisers will review all registrations in line with membership and registration type eligibility criteria. Anyone found to have registered incorrectly will have their registration amended or cancelled accordingly. Additional fees may be payable where registration amendments occur.
In the case of a medical emergency which has caused a registered participant to not attend the Event, the Event Organisers must be provided with a medical certificate or appropriate documentation before any refund will be considered. Where the Event Organisers are advised of the situation after the Event, and a refund is deemed to be appropriate, the participant must still pay the administration fee, along with any accommodation cancellation fees, catering charges and collateral expenses (program, satchel etc) incurred for all events at which they were scheduled to attend.
The Event Organisers reserve the right to cancel, postpone, or change any event at their discretion. In such cases, participants will be notified by email. If an event is cancelled, registration fees will be refunded in full. If postponed, participants may transfer their registration to the new date or request a refund. The Event Organisers are not responsible for any travel or accommodation costs incurred. Participants are encouraged to obtain travel insurance to mitigate any loss on travel or accommodation costs.
Participants must always behave respectfully and responsibly to the Event Organisers prior, during and after the event. Offensive language, harassment, disruption of sessions, or endangerment of others will not be tolerated. The Event Organisers reserve the right to cancel any registration prior to the event or remove any individual without refund should behaviour be deemed inappropriate at the event. By registering for this event, you further agree to adhere to any relevant Code of Conduct as listed on the event’s website.
Images and recordings may be taken by the Event Organisers or authorised service providers during the event for promotional and archival purposes. By attending, you consent to the use of your image or likeness in promotional materials. If you do not wish for your image to be used, you must advise the Event Organisers in writing prior to the event.
Registration fees do not include insurance of any kind. Participants are strongly advised to obtain travel and personal insurance covering loss, injury, illness, property damage, or event cancellation. The Event Organisers accept no responsibility for any loss or damage arising from circumstances beyond its control.
To the extent permitted by law, the Event Organisers’ liability for any claim relating to attendance or participation in the event is limited to the amount of registration fees paid. The Event Organisers shall not be liable for indirect, consequential, or incidental damages including loss of profits, enjoyment, or opportunity.
You agree to indemnify and hold harmless the Event Organisers, its officers, employees, and contractors from and against all claims, damages, liabilities, and expenses arising from your acts, omissions, or breach of these Terms and Conditions, except where caused by the negligence of the Event Organisers.
By registering, you consent to the Event Organisers collecting and using your personal information in accordance with its Privacy Policy. Your name, organisation, and contact details may be shared with event partners for operational purposes. You may opt out of non-essential communications by contacting the Event Organisers at any time.
The Event Organisers may list your company name online as part of a list of attending organisations. If you do not wish your company name to be included, please advise the Event Organisers in writing.
A registration may be transferred to another participant by written notice to the Event Organisers, provided the replacement participant agrees to these Terms and Conditions. No refund will be made where a transfer occurs.
All notices must be sent in writing to the email address of the participant supplied on the registration form. Notices from the Event Organisers will be sent to the participant’s nominated email address and deemed received on the date of transmission, unless outside normal business hours, in which case it is deemed received on the next business day.
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. By registering, you agree to submit to the non-exclusive jurisdiction of the courts of that state.
The Event Organisers shall not be liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, industrial disputes, or equipment failure. In such cases, the Event Organisers may reschedule, modify, or cancel the event without liability, and any refunds will be processed at its discretion.
Participants must comply with all applicable health and safety regulations, venue requirements, and any public health directives in place at the time of the event. The Event Organisers reserve the right to refuse entry or request removal of any delegate who fails to comply or poses a risk to others.
All event content, including but not limited to presentations, videos, images, and materials, remain the property of the Event Organisers or their respective authors. Such content may not be reproduced, distributed, or used for commercial purposes without written consent from the owner.
The Event Organisers reserves the right to amend or update these Terms and Conditions at any time. Updated terms will be published on the event website and are effective upon posting. Continued participation following notice constitutes acceptance of the revised terms.
In the event of a dispute arising under or in connection with these Terms and Conditions, both parties agree to attempt resolution through good-faith negotiation or mediation before commencing legal proceedings.
These Terms and Conditions constitute the entire agreement between the Event Organisers and the participant. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect
